THE
CONSITITUTION OF THE UNION OF MADRASSAH IN DODOMA
PREAMBLE
Whereas, Islam insists upon seeking knowledge through out the whole of ones life;
AND
Whereas, to facilitate that obligation, there is a need
of proper Islamic educational system which is proactive;
AND
Whereas, it is recognized that the Muslims, Madrassah
teachers, Muslim intellectuals, Muslim professionals, and Islamic
institutions can be mobilized and sensitized to work on the important
Islamic institution i.e. Madrassah which have been forgotten and left
for quite a long time;
AND
Whereas, Islam is full of prospects to improve Madrassah
Educational System;
Therefore, in the meeting of

receiving ideas from the meeting of 6 (six) Muslims activitists, on this

do hereby resolve to establish The Union of Madrassahs
in Dodoma.
ARTICLE 1. - DESIGNATION
1.10
NAME
The
union shall be called UNION OF MADRASSAHS IN DODOMA and it shall be
known by its acronym here in as UMADO.
1.20
STATUS
UMADO
is a non-profit charitable and Islamic organization.
1.30
LOCATION AND ADDRESS
The
unions head office will be in Dodoma municipality and its address in
the beginning will be:-

1.40
LANGUAGE.
The
official languages of the Union shall be Kiswahili, Arabic and English.
1.50
DEFINITIONS OF TERMS.
For
the purpose of this Constitution unless the context requires otherwise
the following shall be defined as follows:-
1.51
Amir means Islamic leader who does not lead contrary to
Islamic Shariah.
1.52
Madrassah means Islamic Education Centres whereby the
Muslim children go to study Quran and other related Islamic Religious
subjects.
1.53
Islamic Institutions/Organization means the
institutions run by the Muslims that deal with Islamic issues or
affairs.
1.54
The Board means Board of Trustees of the Union of
Madrassahs in Dodoma.
1.55
Subsidiary Body means an organ formed to strengthen
particular mission of the
Union.
1.56
Subsidiary Rules and Regulation means the rules and
regulations formulated by the Managing Committee as provided in article
8 of this Constitution.
1.57
The
Union means the Union of Madrassahs in Dodoma
1.58
Branch means the Union of Madrassahs with the
objectives and aims similar to those of UMADO.
1.59
Member means any Madrassah or the Islamic Institution
that is the bonafide member of the union.
ARTICLE
2. - AIMS AND OBJECTIVES.
2.10
GENERAL OBJECTIVE.
To
improve Madrassah Education, by systematizing Madrassah Educational
Curriculum and enhancing proper participation of the stakeholders of
Madrassah Education in Tanzania.
2.20
SPECIFIC OBJECTIVES.
In
order to reach its principal goal, the Union shall have the following
specific objectives : -
2.21
To spread and propagate the religion of Islam by
enhancing transfer of Islamic knowledge, skills and moral teachings, and
sensitizing the Muslim Community on responsibility regardless of sects,
colour and race.
2.22
To create similar Curriculum in all Madrassahs.
2.23
To create data base relevant for Madrassah Education and
its betterment.
2.24
To unite, organize and enhance solidarity among the
Madrassah teachers.
2.25
To initiate and Coordinate the nursery school Education
in the Madrassahs.
2.26
To promote learning capabilities among the Madrassah
teachers.
2.27
To enable the transition of some Madrassahs from
traditional nature to modern Islamic primary schools and to enhance
initiation of more and more Islamic primary and secondary schools.
2.28
To enhance poverty eradication in the Community of
Madrassah teachers.
ARTICLE 3. - MEANS TO AIMS AND OBJECTIVES.
In
furtherance of the aims and objectives but not further or otherwise,
UMADO shall work and put effort:
3.1
To build Mosques, Madrassahs, Schools, Orphanages and
such other educational and humanitarian service rendering institutions.
3.2
To publish and distribute religious books, magazines,
periodicals, articles and posters.
3.3
To organize and facilitate training programs for
Madrassah and School teachers and other stakeholders.
3.4
To organize seminars, conferences and discussion on
methodology and Madrassah Education.
3.5
To provide constancy and advisory services in all areas
of management of Islamic Education Institutions.
3.6
To co-operate or affiliate with other institutions in the
Country or elsewhere having aims and objectives in part or similar to
those of UMADO.
3.7
To encourage organizations and individuals whether
members or not, to undertake or provide voluntary support for the
purpose of furthering the aims and objectives of UMADO.
3.8
To organize and persuade collection of Zakah from the
Muslim Community and spend them according to Fiqh (Islamic Shariah)
Laws.
3.9
To organize Religious studies Competition, such as
Quran Competition.
ARTICLE 4. -
MEMBERSHIP.
4.10
The membership of
Union shall be open to
any Madrassah that wishes to become a member. The membership shall also
be open to any Islamic organization or institution that wishes to deal
with the improvement of Madrassahs.
4.20
Madrassah that wishes to be a member shall fill a special
membership form to request membership.
4.40
The Madrassah and/or the
Islamic institution that is a member, shall be represented in the
General Assembly by one up to three but not more than three
representatives.
4.50 Termination.
4.51 The general Assembly shall have the power to
terminate or suspend membership of any Madrassah or Islamic Institution
found to deliberately engage or cause to engage in unislamic behaviour
which dissatisfy the General Assembly.
4.52 A member (Madrassah or Islamic Institution) shall
cease to be a member when it fails to send representatives to attend
four consecutive meetings without any notice/reasonable excuse.
4.53 An appointed member mentioned in Article 4.30 shall
cease to be a member if it deliberately engages or cause to engage in
any activity that is contrary to the aims and objectives of the union OR
is detrimental to the aims and objectives of the union.
4.60
Membership Fees
4.61
Membership fees and annual subscription for each category of membership
shall be determined by the managing committee when need arises and
ratified by a simple majority vote at General Assembly.
ARTICLE
5. - ORGANISATION.
5.0
The union shall be
organized through the uses of the following organs.

General Assembly.
5.2
Board of Trustees
5.3
Managing committee
5.4
Madrassah Teachers Welfare
Development Committee
5.5
Finance and Accounting
Committee
5.10
GENERAL ASSEMBLY
5.11 The
general Assembly shall be composed of all the Madrassahs and Islamic
Institutions who have been registered as bonafide members and enjoy
equal rights of votes.
5.12 The
appointed and/or elected executive committee members would also
automatically be part of the General Assembly and will enjoy rights of
votes representing the Madrassahs or Islamic Institutions they are
coming from.
5.13
Every Madrassah or Islamic
Institution that is a registered member will send as many delegates but
not more than five delegates to represent it in the General Assembly but
all the delegates together will constitute one vote only, as the
delegates are representing one member only.
5.12
The general Assembly shall
hold two types of meetings:-
i)
Ordinary meetings that
shall be held once in a year i.e. Annual meetings.
ii)
Extra ordinary meetings
which can be held any time of the year whenever need
arises.
5.13
The quorum of any Ordinary
General meeting or any Extra Ordinary Meeting shall be not less than 50%
of the members of the General Assembly.
5.14
The agenda shall be
proposed by the Executive committee and posted to Madrassah members by
the at least 10 days before the ordinary meeting of the General
Assembly.
5.15
Any motion in writing
signed by the member proposing it, and at least two members Seconding
such motion and received by the general secretary not later that one
weeks before the date of the General Assembly shall be considered for
inclusion in the agenda for that meeting.
5.16
The General Assembly
meetings shall be chaired by the chairman. If the chairman is
incapacitated or absent the meeting proceedings shall be led by the
vice-chairman. When both are incapacitated or absent, a temporary
chairman shall be elected from those members present constituting a
quorum.
5.17
Where not provide for in
this constitution, the managing Committee shall determine the procedure
for the conduct of the General Assembly.
5.20
Power and duties of
the general assembly.
5.21
The General Assembly shall
be the supreme organ of the Association.
5.22
The General Assembly shall
elect all the office Bearers of the Union
except the chairman and secretary of the Madrassah teachers welfare
committee.
5.23
The General Assembly shall
discuss and approve the annual reports and budget proposal.
5.24
The decision of General
Assembly is supreme to any other decision about the
Union.
5.30
Board of trustees.
5.31
Subject to provisions of
this the union shall form Constitutions Board of trustees.
5.32
The Board shall be composed
of 4 to 10 members be nominated for approval by the General meeting.
5.33
The members of the
executive Committee for approval by the general Assembly and the
Secretary-General of the Union shall be the
member and secretary to the Board.
5.34
The Board shall elect one
of its members to be the chairman of Trustees.
5.35
The term of office for the
Board shall be three (3) years.
5.36
The Board shall meet once
in a year for an ordinary meeting and any other time for extra
ordinary meeting.
5.40
MANAGING COMMITTEE
5.41
The committee shall be
composed of all office bearers as stipulated in Article 6 of this
constitution.
5.42
The term of office for the
committee shall be four years.
5.43
The committee shall hold
quarter annual meetings and extra ordinary meetings whenever need
arise.
5.44
The agenda shall be
communicated to the members of managing committee, not less than 3 days
before the meeting of managing committee.
5.440 POWER AND DUTIES OF THE EXECUTIVE COMMITTEE
5.441
The committee shall supervise all activities of the union.
5.442 The committee shall submit annual
reports to the General Assembly about the activities and Development
Projects of the union.
5.443 The
Committee shall propose the agenda for the General Assembly and post to
all members at leas ten (10) days before the meeting.
5.444
The Committee shall
implement decisions of the General Assembly and shall also oversee the
implementation of the decision of the General Assembly.
5.445
The Committee shall
recommend the name of office Bearers and froward to the General
Assembly.
5.446
The Committee shall process
applications for membership for approval by the General Assembly.
5.447
The committee shall have
power to set up or dissolve subsidiary bodies as may prove desirable in
its view.
5.448
The committee shall
establish a system of collecting Zakat, Sadakat and grant in doing so
the committee may collaborate with any other Islamic institution
organizations. The Committee any also delegate this task to the finance
and Accounting Committee or any other subsidiary body established by the
Managing Committee.
5.50
MADRASSAH TEACHERS
WELFARE COMMITTEE
5.51
The Madrassah teachers
welfare committee shall be composed of all Madrassah teachers from
member Madrassah.
5.52
The Madrassah teachers
welfare committee may appoint its secretary from its members or even out
side if there is any technicality focused.
5.53
The Madrassah teachers
welfare committee will meet twice in a year and shall regulate its
proceedings.
5.54
The term of office for the
Madrassah teachers welfare committee shall be to infinite depending on
the term of office for a Madrassah teacher at his/her Madrassah.
5.55
The Madrassah teachers
shall:-
5.551
Design, prepare and review
project and program proposals according to action plan of UMADO.
5.552
Prepare progress reports
by Compiling reports of member Madrassah and forward to the executive
committee.
5.553
Liaise with other
committees
5.554
Propose activities to be
performed by UMADO to the managing Committee.
5.555
Elect a chairperson who
will be AMIR of the Madrassah teachers from the member Madrassah.
5.60
FINANCE AND
ACCOUNTING COMMITTEE.
5.61
Finance and Accounting
Committee shall have five members appointed by the managing committee
with the exception of chairman and the secretary who will be voted by
the General Assembly.
5.62
The chairman of finance and
Accounting will be the Treasurer of the
Union.
5.63
The Finance and Accounting
shall :
5.631 Prepare and establish an
effective and efficient accounting and internal auditing system as well
as annual budgets and its reviews for the Union.
5.632
Deal with procurement,
stores and supply of inputs and equipment.
5.633 Subject
to Article 4.448 the Finance and Accounting Committee shall mobilize and
collect SADAKAT, ZAKAT, GRANTS and other DONATIONS.
5.634
Hold quarter annual
meetings and extra ordinary meetings whenever arises.
ARTICLE 6: OFFICE BEARERS
6.0
There shall be not less
than seven (7) office bearers of the union.

Vice chairman

Secretary General

Deputy Secretary General

Treasure

The committees chairmen
6.7
The committees secretaries.
6.10
CHAIRMAN
The chairman of the Union shall unless prevented by
illness of other sufficient cause preside over all general Assembly
meetings. He shall be the speaker of the union.
6.11
In case of equality of
votes for and against an issue, the chairman and in his absence, his
vice or the ad hoc chairman shall have a second or casting votes.
6.20
VICE CHAIRMAN.
Shall perform such duties as may be specifically assigned
to him by the chairman and in the absence of the chairman.
6.30
SECRETARY GENERAL.
6.31
Shall be the secretary of
the General Assembly, Board of Trustees and the managing committee.
6.32
Shall issue notice for all
the meeting of the General Assembly, Board of trustees and the managing
committee.
6.33
Shall perform the day to
day executive functions of the Union.
6.34
Shall deal with all
correspondence of the Union.
6.40
Deputy Secretary
General
6.41
Shall perform all duties of
the Secretary General in absence of the Secretary General.
6.42
Shall perform such duties
as may be specifically assigned to him by the secretary general.
6.50
TREASURER.
6.51
Shall be the financial
Controller of the Union.
6.50
Shall be the Chairman to
the Finance and Accounting Committee.
6.51
Shall maintain proper
comprehensive books of accounts for all moneys received and expenses to
be incurred and moneys paid by the union. All such books will be
properly written up, preserved and made available to the managing
committee when required.
6.60
Committees'
Chairmen.
6.61
In case of equality of
votes for and against an issue, the chairman and in his absence, the ad
hoc chairman shall have casting votes.
6.62
In case of equality of
votes for and against an issue, the Chairman and absence, the ad hoc
chairmen shall have casting votes.
6.70
Committee
Secretaries.
6.71
Shall perform day today
executive functions of the committees.
6.72
Shall issue notices
concerning all the meetings of the committees and shall be responsible
for keeping minutes of all such meetings and for preservation of all
records of the proceedings of the meetings.
ARTICLE 7. FINANCIAL REGULATIONS.
7.0
The union shall have
financial regulations here in stipulated.
7.1
The books of accounts shall
be kept at the official office of UMADO or at an alternative approved
venue, which the managing committee has appointed. The books shall
always be open to the inspection of the managing committee or any member
there of.
7.2
Auditors approved by the
managing committee shall audit the annual accounts of the union.
7.3
At the General Assembly a
report of the affairs of the union, together with an audited statement
of income and expenditure and balance sheets made to the end of the year
shall be submitted for comments and approval.
7.4
The union shall contribute
to and receive donations from, other related institutions as greed upon
by the managing committee.
7.5
The money exceeding
100,000/= Tshs shall be deposited in the unions Account.
7.6
Signatories will be two of
the Treasurer, the chairman and the secretary.
ARTICLE 8. SUBSIDIARY RULES AND REGULATIONS.
8.0
For the purpose of day to
day undertakings, managing committee may set subsidiary rules and
regulations, which may bring about efficiency and effectiveness.
8.1
When subsidiary rules and
regulations contradict this constitution such rules and regulations are
automatically nullified, as they will be unconstitutional herein.
8.2
Where the General Assembly
is against the established rules and regulations by the managing
committee, such rules and regulations shall not be used in the running
of the union.
8.30
The procedures for
establishing subsidiary rules and regulations are here under stipulated.
8.31
The suggestions on rules
and regulations of managing committee should be submitted to the
secretary-general before the meeting, which will discuss such
suggestions.
8.32
The secretary will give
notice to the members of managing committee before the meeting subject
to article (5.44) of this constitution.
8.33
When the meeting of
managing committees passes rules and regulations the secretary General
will put into writings and the same will be signed by all the members of
managing committee other wise the rules and regulations will not be
considered as subsidiary rules and regulation.
ARTICLE 9 INDEMNITY.
If
any prosecution, action of legal suit, be charged against any member of
the managing committee there of, for any thing done by him/her in the
proper and reasonable discharge of his/her duties, he/she shall be
defended and indemnified by and at the cost of the union from all
damages, cost and expenses which may be incidental to or result from
such prosecution, action or suit at law and the property and funds of
the union may be applied for this purpose.
ARTICLE 10 PROPERTY OF THE UNION.
10.1
All movable and fixed
assets of the union shall be entered in the
Unions register and included in the treasurers report
during the General Assembly.
10.2
The income and property of
the union however derived shall be applied solely towards the promotion
of objective of the union as set forty in this constitution.
10.3
In case of dissolution the
register of the union will be notified, and the assets of the union
shall be entrusted to the best institutions in terms of performance and
closest to UMADO in objectives.
ARTICLE 11 CODE OF CONDUCT.
11.1
All categories of members
of UMADO shall be expected to be good and Committed strictly adhering to
the constitution of the union.
11.2
Any flagrant breach of
Article 11.1 above may call for stern disciplinary action from the
relevant body of the union.
11.3
Disciplinary actions that
may be taken range from stern warning, suspension and/or expulsion
respectively.
11.4
At each level of
disciplinary action the relevant body shall be the general Assembly,
except when the disciplinary action is against the member of subsidiary
body. In such a case the relevant body shall be the managing committee.
11.5
The person or the member
against who, the disciplinary measures are sought to be taken shall be
given an adequate opportunity to defend his case.
11.6
The decision of the General
Assembly on disciplinary actions shall not be further Applebee.
ARTICLE 12. DISSOLUTION.
12.1 The
union shall be dissolved except by a resolution passed by three fourth
majority of the members of the managing committee present at the meeting
of such committee convened on that behalf.
12.2 The
members of managing Committee shall write their proposal to dissolve the
union to the board of trustees and at least two-third of the managing
committee should sign such a proposal.
12.3 The
meeting of both Boards of Trustees and managing Committee together under
the chairmanship of the chairman of the Board shall pass the resolution
and give permission for dissolution subject to Article 12.4 of this
constitution.
12.4 The
permission for resolution referred to in Article 12.3 shall be obtained
if two third of the members present in the meeting and the condition
under provision of Article 12.1 is met in that meeting.
12.5 Subject
to payment of all liabilities of the union, the balance if any shall be
handed over to any other Islamic institution as clearly stated in
Article 10.3
ARTICLE 13: THE CONSTITUTION.
13.10 The
power to interpret this constitution shall be the prerogative of the
General Assembly of the Union.
13.20 Amendments
to Constitution unless the procedures for amendment herein stated are
adhered to, this constitution or any part of it shall not be amended.
The procedures for amendment are as hereunder stated.
13.21 Any
proposal for amendment shall be presented to the managing committee for
discussion and recommendations prior to the General Assembly.
13.22 After
discussion and drafting it, the proposal and recommendations shall be
circulated among the members of the union for study at least four (4)
weeks before the General Assembly.
13.23 Any
amendment, alternative and/or substitute to the constitution must be
approved by at least two third majority of the members present in that
meeting of General Assembly.
13.24 The
changes if any will be presented to the Board of trustees after being
approved by the general Assembly.
13.25 The
Board shall have no power to dissolve the amendment by the General
assembly.
ARTICLE 14. BRANCHES.
14.1 Managing
committee may open branches in other districts of
Dodoma region after being permitted by the General
meeting.
14.2 The
branches shall conduct their meetings and other activities on their own
but sending reports to the managing committee.
14.3 When
branches mature enough their managing Committee and the mother managing
committee shall meet to discuss on how to work together and prepare a
proposal, recommendations and opinions to the Annual ordinary meeting of
the General Assembly here in refereed.
ARTICLE 15. THE OFFICIAL SEAL.
15.0
There shall be official
seals of the union as here under mentioned.
15.10 The
official seal of the Secretary General.
15.11 The
seal bearing the title of the secretary, and the name of the union to be
affixed to all official reports, legal documents, correspond, letters,
and receipt books and other financial records.
15.12 The
seal just bearing the name union of Madrassah Dodoma which will be
affixed to all other Islamic education books, the union files than those
which are kept by the secretary internal memos among the members of
managing committees. |
